Association Committee Charter

 

Committee Name:  Compliance  BEC

Purpose of the team:
The goal of the Compliance Committee of Waterside at the Lakes is to establish a panel of unbiased peer association members to review and rule on violation submitted by the board of directors.

Scope of the team:
The Compliance committee shall be comprised of a minimum of 3 member volunteers from the Waterside at the Lakes. They may not be officers, directors, or employees of the association, or the spouse, parent, child, brother, or sister of an officer, director, or employee.
 

Givens or Boundaries:
The Compliance committee shall be entrusted to;

  • Follow all governmental laws, regulations, and policies regarding compliance/fining of association members.
  • The committee must afford basic due process and allow the accused to be heard, state his or her case, and challenge evidence against him or her. The committee must then either “confirm” or “reject” the fine levied by the board of directors. 

 

Decision Making Process and Fallback:
If the committee rejects the fine, the matter is concluded.
If the committee confirms the fine, the fine is deemed to be imposed
Decision making will be strictly within the committee.
The Board of Directors shall have no influence on the committee decision.

 

Timeline:
This is a Mandatory Committee, with reoccurrence bi-monthly as necessitated.

  

Meeting times and frequency:  
Hearing before the Compliance Committee requires fourteen days’ notice to the member being reviewed, allowing additional time for transmission or delivery of the notice.
